Execution proceedings. Being granted a court verdict with an enforcement clause strengthens the creditor’s position in negotiations with the debtor paves the way for bailiff execution.
Execution proceedings involve the following actions:
- Sending a final call for payment;
- Conducting negotiations with debtor;
- Selecting a bailiff;
- Informing the bailiff about the debtor’s property;
- Supervising the claim-securing proceedings;
- Obtaining a decision on the ineffectiveness of execution;
- Signing an agreement during execution proceedings and monitoring payments.
Execution proceedings are concluded when the whole amount of infested funds – or their agreed part – is recovered, or when execution is deemed ineffective. However, the latter does not mean the end of debt recovery procedures. As long as the court does not issue a decision on winding up bankruptcy proceedings, this process can be repeated indefinitely.
